Terms of Sale

Article 1 — Seller identity and scope

These Terms of Sale govern consumer purchases made through nexamclean.com. The seller is: RBC Group LLC, trading as Nexam Wyoming limited liability company Wyoming filing ID: 2025-001839878 Registered office: 30 North Gould Street, Suite N, Sheridan, Wyoming 82801, United States Customer service: support@nexamclean.com Legal and privacy contact: robin@rbcgrp.eu These Terms apply to consumers acting for purposes outside their trade, business, craft or profession. By placing an order, you confirm that you have read and accepted these Terms, without prejudice to mandatory consumer-protection rules that apply in your country of habitual residence.

Article 2 — Products and pre-contract information

The essential characteristics, price, included accessories, availability and any applicable safety information for each product are shown on its product page before purchase. We take reasonable care to ensure that descriptions, photographs and specifications are accurate. Screen settings, lighting and manufacturing tolerances may cause minor visual differences that do not affect conformity. Nothing in these Terms allows Nexam to deliver a product that materially differs from the description or agreed characteristics. You are responsible for checking that the product is suitable for your intended normal use, based on the information supplied. Article 3 — Availability

Products are offered subject to availability. An item shown as available may exceptionally become unavailable before the order is accepted. If we cannot fulfil an accepted order, we will inform you and refund all amounts paid without undue delay. We may propose an alternative, but no substitution will be made without your express agreement.

Article 4 — Prices, taxes and delivery charges

Prices are displayed in euros and the total amount payable is shown before the order is confirmed. Standard delivery to supported destinations is free of charge. The checkout total must include all amounts charged by Nexam for the order. Nexam will not add undisclosed charges after the order has been placed. Where taxes, customs formalities or import charges apply, Nexam will only accept and dispatch orders under a delivery arrangement intended to prevent unannounced charges being demanded from the consumer on delivery. The operational tax and import treatment must match the information presented at checkout and on the invoice. Nexam may change prices at any time, but a change does not affect an order already accepted. In the event of an obvious pricing or technical error that a reasonable consumer should have recognised, we may contact you to confirm the correct price or cancel and refund the order.

Article 5 — Order process

The online order process normally consists of the following steps: 1. Select the product and any available options. 2. Add the product to the cart. 3. Review the cart, quantities, price and delivery information. 4. Enter contact, billing and delivery details. 5. Select an available delivery and payment method. 6. Review the final order summary and correct any errors. 7. Confirm acceptance of these Terms and the applicable policies. 8. Submit the order using a button or function that clearly indicates an obligation to pay. 9. Complete payment authentication where required. 10. Receive an electronic order acknowledgement or confirmation. You can correct input errors before submitting the order by returning to the relevant checkout step or editing the cart.

Article 6 — Formation and acceptance of the contract

Submitting an order is an offer to purchase. The sales contract is formed when Nexam sends an email expressly confirming acceptance of the order, or when the order is dispatched, whichever occurs first. An automated acknowledgement that the order has been received does not by itself guarantee acceptance where payment fails, the product is unavailable, delivery is unavailable, the order triggers a reasonable fraud or security concern, the quantity is clearly incompatible with normal consumer use, or there is an obvious pricing error. If an order is not accepted after payment has been authorised or captured, the corresponding amount will be released or refunded without undue delay. The order confirmation and these Terms are provided electronically. You should save them for your records.

Article 7 — Payment

Payment is due when the order is submitted. The payment methods available are those displayed at checkout, which are controlling. They currently include payment cards (Visa and Mastercard) and accelerated digital wallets, namely Apple Pay and Google Pay. Payments are processed by authorised payment-service providers. Nexam does not receive or store your complete payment-card number. You confirm that you are authorised to use the selected payment method and that the billing information supplied is accurate. An order may be suspended or cancelled if payment is refused, reversed or identified as potentially fraudulent, subject to applicable law.

Article 8 — Delivery

Nexam currently accepts orders for mainland France, Belgium, Luxembourg, Germany, Austria, Italy, Spain, Poland and the Netherlands, subject to the destinations enabled at checkout. Delivery is free of charge and normally takes 5–8 business days from order confirmation. The detailed delivery rules, tracking process and remedies for delay are set out in the Shipping, Returns & Refunds Policy, which forms part of these Terms. If the announced delivery period cannot be met, mandatory remedies available under the consumer law of your country remain fully applicable.

Article 9 — Transfer of risk and ownership

Risk of accidental loss or damage transfers to you when you, or a third party designated by you other than the carrier, physically receives the product. Ownership transfers once full payment has been received, subject to mandatory law.

Article 10 — Statutory withdrawal and 30-day trial

EU consumers normally have a statutory right to withdraw from a distance contract within 14 calendar days after receipt, without giving a reason. Nexam extends the return period to 30 calendar days after delivery through a commercial home-trial offer. The statutory withdrawal right and the additional commercial period are explained separately in the Shipping, Returns & Refunds Policy. To withdraw, send an unambiguous statement to support@nexamclean.com or use the model form annexed to these Terms. The direct cost of returning the product is borne by the customer for eligible returns. During the statutory withdrawal period, you are liable only for diminished value caused by handling beyond what was necessary to establish the product’s nature, characteristics and functioning. Additional conditions for the commercial period from day 15 to day 30 are stated in the Shipping, Returns & Refunds Policy.

Article 11 — Refunds

For statutory withdrawal, Nexam refunds all payments received, including standard outbound delivery charges, within 14 days after being informed of the withdrawal. Nexam may withhold reimbursement until the product is received or proof of return is provided, whichever occurs first. Refunds are made through the original payment method unless another method is expressly agreed. Article 12 — Legal guarantee of conformity

Nexam is responsible, as seller, for delivering goods that conform to the contract. Consumers benefit from the mandatory legal guarantee of conformity provided by the law applicable in their country of residence. For consumers resident in France, a new product is covered by the legal guarantee of conformity for two years from delivery. A lack of conformity appearing during that period is presumed to have existed at delivery, subject to the conditions provided by law. Where the legal guarantee applies, the consumer may request repair or replacement, unless the chosen remedy is impossible or imposes disproportionate costs compared with the alternative. The remedy must be provided free of charge, without major inconvenience and within the time required by applicable law. Where repair or replacement is refused, impossible, excessively delayed or otherwise unsuccessful in circumstances defined by law, the consumer may be entitled to a price reduction or termination of the contract and refund. A repair under the French legal guarantee may extend the guarantee period in accordance with French law, and a replacement may start a new legal guarantee period. To exercise the legal guarantee, contact support@nexamclean.com. Nexam will not require you to pursue the manufacturer instead of the seller.

Article 13 — Hidden defects and other mandatory warranties

Consumers may also benefit from protection against hidden defects and any other mandatory warranties available under the applicable national law. For consumers resident in France, the legal guarantee against hidden defects applies where a hidden defect existing at the time of sale makes the product unfit for its intended purpose or substantially reduces its usefulness. Subject to legal conditions, the consumer may seek cancellation of the sale or a reduction in price. Nothing in these Terms excludes or limits a statutory guarantee or remedy that cannot lawfully be excluded.

Article 14 — No separate commercial warranty unless expressly stated

The statement “24-month guarantee” on the site refers to the applicable legal guarantee of conformity unless a separate written commercial warranty document expressly states otherwise. No separate commercial warranty is created by these Terms. Any future commercial warranty must be provided in a separate durable document describing the guarantor, territorial scope, duration, coverage, exclusions and claims procedure, and must remain additional to statutory rights.

Article 15 — Product safety, instructions and recalls

Use the product only for its intended purpose and follow the supplied instructions, warnings, charging guidance and maintenance requirements. If Nexam becomes aware of a product-safety issue, it may contact affected customers using order information and take appropriate corrective action, including safety notices, repair, replacement, withdrawal or recall. Customers must not use a product after receiving a notice requiring use to stop. Nothing in this article limits Nexam’s obligations under applicable product-safety law.

Article 16 — Customer service and complaints

Questions and complaints may be submitted through the online contact form or by email to support@nexamclean.com. Customer-service hours are Monday to Friday, 9:00 am–6:00 pm, Paris time, excluding public holidays. Every complaint is reviewed carefully, and Nexam will respond as soon as reasonably possible. Please include the order number and a clear description of the issue. For damage or defects, photographs may help us assess the request but are not a substitute for statutory rights.

Article 17 — Alternative dispute resolution

Nexam first invites consumers to contact support@nexamclean.com so that an amicable solution can be sought. Where an alternative dispute-resolution or consumer-mediation procedure is mandatory or available under the law of the consumer’s country, the consumer may use a competent entity in accordance with that procedure. The former European Commission Online Dispute Resolution platform is no longer in operation and is not referenced in these Terms. This article does not restrict access to a competent court.

Article 18 — Liability

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, defective products where liability cannot be excluded, breach of mandatory consumer rights, or any other liability that cannot lawfully be limited. Subject to those mandatory rules, Nexam is not responsible for losses that were not reasonably foreseeable when the contract was formed, or for losses arising from use of the product for business, resale or another non-consumer purpose where the buyer purchased as a consumer. Temporary website interruption does not affect rights arising from an accepted order.

Article 19 — Events beyond reasonable control

Nexam is not liable for delay caused by an event genuinely beyond its reasonable control, such as severe transport disruption, natural disaster, governmental action, war, major cyber incident or widespread carrier interruption, provided that Nexam takes reasonable steps to reduce the effects and informs affected customers. This article does not remove any right to cancel or obtain a refund that mandatory law grants because of delayed or failed delivery.

Article 20 — Personal data

Personal data is processed in accordance with the Nexam Privacy Policy and Cookie Policy. Payment information is processed by payment-service providers under their own security and compliance obligations.

Article 21 — Intellectual property

The Nexam name, branding, site content, product visuals and original materials are protected by intellectual-property rights belonging to RBC Group LLC or its licensors. Purchasing a product does not transfer any intellectual-property rights.

Article 22 — Governing law and courts

To the extent permitted by mandatory law, these Terms are governed by the laws of the State of Wyoming, United States. If you are a consumer habitually resident in the European Union, this choice does not deprive you of the mandatory consumer protections that would apply in your country of habitual residence in the absence of that choice. You may bring proceedings before any court that has jurisdiction under the mandatory rules applicable to consumer contracts. Nexam does not require an EU consumer to waive the jurisdictional protections available in their country of residence.

Article 23 — Severability and no waiver

If a provision of these Terms is held invalid or unenforceable, the remaining provisions continue to apply to the extent legally possible. A delay by Nexam in enforcing a contractual right does not waive that right.

Article 24 — Changes to these Terms

The version in force when an order is accepted governs that order. We may update these Terms for future orders to reflect changes in law, operations or services. The revision date appears at the top of the page.

Article 25 — Language

These Terms may be provided in several languages. The version presented to you during checkout applies to your order, subject to mandatory interpretation rules. A translation does not reduce consumer rights.

Annex — Model withdrawal form
